Terms of Use

These Terms of Use ("Terms") govern your use of the Babylytics iOS app, Apple Watch app, widgets, website, and related services (collectively, the "App"). By downloading, installing, accessing, or using Babylytics, you agree to these Terms.

If you do not agree, do not use the App.

1. Eligibility and Account

• The App is intended for personal, non-commercial use by parents and caregivers.
• You are not required to manually sign up. Babylytics creates an account automatically in-app.
• Account access on another device is restored using the in-app QR flow.
• You are responsible for your device security and activity under your account.

2. License

Subject to these Terms, Babylytics grants you a limited, revocable, non-exclusive, non-transferable license to use the App for personal use on Apple-authorized devices.

You may not:

• Reverse engineer, decompile, or disassemble the App except where prohibited by law.
• Copy, modify, distribute, sell, lease, sublicense, or commercially exploit the App or any part of it without permission.
• Use the App in ways that interfere with service integrity, security, or availability.

3. Free and Paid Features

• Babylytics includes free features and paid features.
• Some functionality (such as advanced insights, Sleep Schedule plans, and premium tools) may require an active subscription.
• Feature availability may vary by country, device, and app version.

4. Subscriptions and Billing

• Paid subscriptions are processed by Apple through your App Store account.
• Subscriptions may auto-renew unless canceled through Apple subscription settings.
• Billing, cancellation timing, and refund handling are managed by Apple under Apple's terms and policies.
• You can use "Restore Purchases" to recover eligible purchases on the same Apple account.
• Prices and plan availability can change and will be shown in-app before purchase.

5. Acceptable Use

You agree not to:

• Use the App for unlawful, fraudulent, or abusive purposes.
• Attempt unauthorized access to accounts, systems, or data.
• Upload malware or perform activity that disrupts users, networks, or infrastructure.
• Use automated means to scrape, overload, or interfere with the App.

6. Health Disclaimer

• Babylytics is an informational parenting tool and is not a medical device.
• App insights and reminders do not replace professional medical advice, diagnosis, or treatment.
• For medical concerns or emergencies, contact a qualified healthcare professional or emergency services.

7. Third-Party Services

The App uses third-party services (including Apple, Supabase, and Firebase) for core functionality such as subscriptions, sync, analytics, and push infrastructure.

Use of those services is subject to their own terms and privacy policies.

8. Intellectual Property

All rights, title, and interest in the App, including software, branding, text, graphics, and content, are owned by Babylytics or its licensors and protected by applicable intellectual property laws.

9. Termination

We may suspend or terminate access if you violate these Terms or use the App in a harmful or unlawful way. You may stop using the App at any time and may request account deletion through available in-app settings.

10. Disclaimers

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted, error-free, or fully secure operation.

11. Limitation of Liability

To the maximum extent permitted by law, Babylytics will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business arising from or related to use of the App.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the date above and, where appropriate, by in-app notice. Continued use after updates means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws applicable where Babylytics is established, without limiting mandatory consumer protections available under the laws of your place of residence.
